| 34 — Należy zauważyć, że sąd najwyższy Stanów Zjednoczonych wypracował tę koncepcję poprzez ponadstuletnie orzecznictwo, w szczególności po przyjęciu czternastej poprawki, na której jak wiadomo opiera się wyrok w sprawie Dred Scott przeciwko Sandford, 60 U.S. (19 How.) 393 (1856), a także w następstwie wojny domowej, która skapała w krwi młodą federację w latach 1861–1865. Poprawka ta stanowi, że „all persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States”. | 34 — It is appropriate to point out that the United States Supreme Court took the same approach throughout a century of caselaw, most notably after the adoption of the 14th amendment, which, as is well known, derives its subjectmatter from Dred Scott v Sandford (60 U.S. (19 How.) 393 (1856)) and from the subsequent Civil War which bathed the young Federation of States in blood between 1861 and 1865. |
